1. Agreement to Terms
By accessing or using WhatsApp Receptionist ("the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
WhatsApp Receptionist is a software-as-a-service platform that provides AI-powered automated messaging for dental clinics through the WhatsApp Business Platform. The Service:
- Receives patient messages on your WhatsApp Business number
- Generates AI-powered responses to handle common patient inquiries
- Assists with appointment booking, clinic information, and general questions
- Allows your team to manage and oversee conversations
3. Account Registration
To use the Service, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Have a valid WhatsApp Business account
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any purpose other than dental clinic patient communication
- Send spam, unsolicited messages, or marketing communications through the Service
- Provide false or misleading information to patients through the Service
- Use the Service to provide medical advice, diagnoses, or treatment recommendations
- Attempt to reverse-engineer, decompile, or hack the Service
- Violate any applicable laws, regulations, or third-party rights
- Interfere with or disrupt the Service or its infrastructure
5. AI-Generated Content
5.1 Nature of AI Responses
The Service uses artificial intelligence to generate responses to patient messages. You acknowledge that:
- AI-generated responses are not medical advice and should never be treated as such
- The AI acts as an administrative assistant only (appointment booking, clinic information, general inquiries)
- AI responses may occasionally be inaccurate or inappropriate
- You are ultimately responsible for all communications sent through your WhatsApp Business account
5.2 Human Oversight
You agree to:
- Regularly monitor AI-generated conversations through the dashboard
- Intervene when the AI escalates conversations to your team
- Maintain human oversight of the AI's communications
- Correct any errors or inappropriate responses promptly
6. WhatsApp Business Platform
6.1 Compliance
By using the Service, you agree to comply with:
- Meta's Platform Terms
- WhatsApp Business Platform Terms
- WhatsApp Business Policy
- Meta's Community Standards
6.2 WhatsApp Account
You are responsible for:
- Maintaining your WhatsApp Business account in good standing
- Complying with WhatsApp's messaging policies and rate limits
- Ensuring your WhatsApp Business profile accurately represents your clinic
7. Subscription and Payment
7.1 Pricing
The Service is offered on a subscription basis. Current pricing is available on our website. We reserve the right to change pricing with 30 days' notice.
7.2 Billing
- Subscription fees are billed in advance on a recurring basis
- All fees are non-refundable unless otherwise stated
- You are responsible for providing valid payment information
7.3 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation:
- Your access continues until the end of the current billing period
- After the billing period ends, your account data will be retained for 30 days before deletion
- WhatsApp access tokens are revoked immediately
8. Intellectual Property
8.1 Our Property
The Service, including its design, features, functionality, and content, is owned by WhatsApp Receptionist and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service.
8.2 Your Content
You retain ownership of any content you provide through the Service (clinic information, configurations, etc.). By using the Service, you grant us a limited license to use this content solely to provide and improve the Service.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind
- We do not guarantee that the AI will generate accurate, appropriate, or error-free responses
- We are not liable for any damages arising from AI-generated content
- We are not liable for any loss of business, revenue, or data
- Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
10. Indemnification
You agree to indemnify and hold harmless WhatsApp Receptionist, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- AI-generated content sent through your WhatsApp Business account
- Any claim that your use of the Service violates third-party rights
11. Termination
We may terminate or suspend your account immediately, without prior notice, if:
- You breach these Terms
- Your use of the Service violates applicable laws or WhatsApp's policies
- We are required to do so by law
- We discontinue the Service
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Bulgaria.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
